This is because litigation can linger for years, is expensive, and is further complicated by the inherent uncertainty that comes from leaving the outcome in the hands of a judge or jury. Mediation provides a less expensive and more efficient alternative in which the parties can regain control over the process, and under the guidance of a skilled mediator, proceed to develop practical business solutions that meet their specific interests.

Ms. Gupta’s mediation services start well in advance of the day of mediation and continue after the session ends.  

Before the mediation, Ms. Gupta devotes significant time preparing to establish a solid foundation for the day of mediation. Focusing on submissions from counsel and holding telephone calls with each party, Ms. Gupta will ensure that she understands the nature of the case, the substantive issues involved, the parties’ objectives, and any relevant history between the parties.  

During the mediation, she will ensure the lines of communication are open and, through shuttled diplomacy, work with the parties to facilitate progress, problem-solve, explore solutions, and outline the parameters of a negotiated resolution.

After the mediation, she will continue to work with the parties until any oral agreement is formalized in writing and be available to address any ongoing disagreements that may ensue. In the event the parties did not reach a negotiated resolution, she will continue to assist the parties as requested to help find opportunities to re-engage.

Throughout the entire process, if at any stage she determines that a settlement is not obtainable, she will inform the parties immediately to help save them unnecessary time and legal expense and avoid the ripple effects that a negative mediation can have on the parties’ ongoing relationship and future negotiations.
